1. Introduction and identification
These Terms and Conditions apply, without restriction or reservation, to all sales concluded by Impertinent Design Studio, a sole proprietorship (micro-entreprise) located at La Roussière, 27270 Mesnil-en-Ouche, France, registered under SIRET number 10826358300016, hereinafter referred to as "the Seller", with non-professional buyers, hereinafter referred to as "the Customer", wishing to purchase products offered for sale on the website https://impertinentdesignstudio.com.
2. Products and characteristics
The products offered are handcrafted decorative objects made from concrete, wood, and other materials.
Handcrafted nature: The Customer acknowledges that all products are made by hand. As a result, each piece is unique. Variations in colour, texture, the presence of micro-bubbles (in concrete) or knots (in wood) are not defects, but inherent characteristics of the material and handmade process.
Personalization: Some products include personalization (names, phrases, logos). The Customer is responsible for the accuracy of any text or spelling provided at the time of order.
3. Pricing and payment
All prices are shown in Euros (€). In accordance with French tax law (article 293 B of the Code Général des Impôts), VAT is not applicable.
Payment is due immediately upon ordering via PayPal, which accepts credit and debit cards without requiring a PayPal account.
4. Delivery and timeframes
Products are delivered to the address provided by the Customer.
Processing times: Standard items require 2 to 3 weeks to make before shipping. Personalized items require 3 to 4 weeks.
Shipping: The Seller accepts no responsibility for delivery delays caused by shipping carriers (La Poste, Mondial Relay, etc.).
5. Right of withdrawal
In accordance with article L221-18 of the French Consumer Code, the Customer has 14 days to exercise their right of withdrawal for non-personalized products. Return shipping costs are the sole responsibility of the Customer.
Exception for personalized products: In accordance with article L221-28 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the Customer's specifications or clearly personalized. Orders featuring a name, date, or specific inscription cannot be returned, exchanged, or refunded, except in the case of a proven error on the part of the Seller.
6. Warranties and disputes
Products are covered by the statutory warranty of conformity (articles L217-4 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code).
In the event of a dispute, an amicable resolution will be sought before any legal action. Failing that, the competent court will be that of the Seller's registered address.
